PAGELITE TERMS OF SERVICE

Welcome to PageLite.

These Terms of Service ("Terms") govern your use of the PageLite website and any purchases made through our online store.

By accessing our website, creating an order, purchasing a product, or otherwise using our services, you agree to these Terms.

These Terms must be read together with our Privacy Policy, Shipping & Delivery Policy and Returns & Refund Policy.

Nothing in these Terms is intended to exclude, restrict or reduce any rights you may have under applicable South African law, including the Consumer Protection Act 68 of 2008 ("CPA") and the Electronic Communications and Transactions Act 25 of 2002 ("ECTA").

If any provision of these Terms conflicts with a mandatory provision of South African law, the applicable law will take precedence.

1. About PageLite

PageLite operates an online retail store offering reading accessories, lighting products, customised products and other related goods.

2. Using Our Website

You may use the PageLite website only for lawful purposes.

You may not use the website to engage in fraudulent activity, interfere with the operation or security of the website, attempt to gain unauthorised access to our systems, submit false information, impersonate another person, introduce malicious software, scrape or copy substantial portions of our website without permission, or use our services in a manner that violates applicable law.

We reserve the right to restrict access to our website where we reasonably believe that the website, payment system, checkout process or customer service channels are being abused or used unlawfully.

3. Product Information

We aim to provide accurate descriptions, photographs, specifications and other information for products offered on PageLite.

Product images are intended to represent products as accurately as reasonably possible. However, minor differences in colour, appearance, packaging or presentation may occur because of lighting, photography, screen settings, manufacturing updates or other reasonable variations.

These reasonable variations do not affect any statutory rights relating to goods that are materially different from what was ordered, defective, unsafe or otherwise fail to meet the requirements of applicable consumer law.

Product dimensions and specifications displayed on a product page should be reviewed before placing an order.

4. Product Availability

Products are offered subject to availability.

Adding a product to your cart does not reserve that product.

If we are unable to fulfil an accepted order because a product has become unavailable, we will notify you and provide the refund or other remedy required by applicable law.

We may limit quantities where reasonably necessary to prevent fraud, resale abuse, stock errors or other legitimate operational problems.

5. Prices

Unless otherwise stated, all prices displayed on PageLite are in South African Rand (ZAR).

The price applicable to an order will be the price displayed during checkout when the order is submitted, subject to applicable law concerning displayed prices and genuine pricing errors.

Any applicable delivery fees, taxes and other charges will be disclosed during the purchasing process where required.

We may change product prices from time to time. Changes will not ordinarily affect an order already accepted and paid for, except where applicable law permits otherwise.

6. Obvious Pricing or Website Errors

We make reasonable efforts to ensure that product information and pricing are accurate.

If an obvious technical, typographical or system error results in incorrect information being displayed, we may contact you before fulfilling the affected order to explain the issue.

Any action taken in relation to a pricing or listing error will remain subject to the Consumer Protection Act and other applicable South African law.

Nothing in this clause allows PageLite to disregard statutory obligations relating to displayed prices.

7. Placing an Order

Before submitting an order, customers are given an opportunity through the website's cart and checkout process to review the products selected, quantities, delivery information and applicable charges and to correct mistakes before finally placing the order.

You are responsible for ensuring that the information supplied during checkout is accurate and complete.

After placing an order, you should receive an electronic order confirmation.

An order number should be kept for customer-service enquiries.

We reserve the right to investigate or decline orders where there are reasonable grounds to suspect fraud, payment abuse, unauthorised use of payment information or another unlawful activity.

Any cancellation or refund in those circumstances will be handled in accordance with applicable law.

8. Payment

Payment must be made using one of the payment methods made available during checkout.

By submitting payment information, you represent that you are authorised to use the selected payment method.

Payment transactions may be processed by third-party payment providers. PageLite does not necessarily receive or store your complete payment-card information.

Payment information is also subject to the terms, security procedures and privacy practices of the applicable payment provider.

If a payment is declined or cannot be verified, the order may not be processed.

9. Order Verification

For fraud prevention and customer protection, PageLite may reasonably request additional information to verify an order.

This may include confirming contact information or information relating to the order.

We will never ask you to provide sensitive payment credentials such as your full banking password or card PIN.

Where additional verification is reasonably necessary, fulfilment may be delayed until verification is completed.

10. Delivery

Delivery estimates displayed on our website or communicated after purchase are estimates unless a specific delivery period has expressly been agreed.

More detailed information about delivery areas, estimated delivery periods, tracking and shipping charges is contained in our Shipping & Delivery Policy.

We will take reasonable steps to fulfil orders within the period communicated to the customer and within any period required by applicable law.

Where ECTA applies, orders must be executed within the period required by law unless another period has been agreed with the customer.

Goods being delivered remain at PageLite's risk until delivery has been accepted by the customer to the extent required by the Consumer Protection Act.

11. Delivery Information Provided by the Customer

Customers must provide a complete and accurate delivery address and contact information.

PageLite is not responsible for delays directly caused by materially incorrect delivery information supplied by the customer, provided that this does not limit any responsibility that PageLite cannot lawfully exclude.

We cannot guarantee that an address can be changed once an order has entered the fulfilment or delivery process.

12. Delayed Deliveries

Courier delays, high-volume periods, adverse weather, operational disruptions and other circumstances may sometimes affect delivery estimates.

Where we become aware of a material delay, we will take reasonable steps to communicate with the affected customer.

Nothing in this section removes any cancellation or other rights that a customer may have where an order is not delivered within an agreed or legally required period.

13. Lost, Damaged or Incorrect Deliveries

If an order appears to be lost, arrives damaged, contains an incorrect item or materially differs from what was ordered, contact us as soon as reasonably possible at:

Please provide your order number and information reasonably necessary for us to investigate the problem.

Photographs or video may be requested where useful for establishing damage, an incorrect item or another physical problem.

Any remedy will be handled in accordance with applicable South African consumer law and our Returns & Refund Policy.

14. Returns, Cancellations and Refunds

Returns, cancellations and refunds are governed by our Returns & Refund Policy, which forms part of these Terms.

For eligible electronic transactions, customers may have a statutory cooling-off right under ECTA.

Where that statutory right applies, it takes precedence over any voluntary PageLite policy.

After any applicable statutory change-of-mind period has expired, PageLite may offer the voluntary return arrangement described in our Returns & Refund Policy, including the 50% goodwill refund arrangement for approved change-of-mind returns where no statutory entitlement to a full refund applies.

The 50% goodwill arrangement does not apply where applicable law gives the customer a right to a full refund, repair, replacement or another remedy.

15. Defective Goods and Statutory Warranty

Goods supplied by PageLite remain subject to the quality standards and statutory warranties imposed by the Consumer Protection Act.

Where goods fail to meet applicable statutory standards, customers may have rights including repair, replacement or refund.

In particular, where section 56 of the Consumer Protection Act applies, qualifying failed, unsafe or defective goods may be returned within the statutory six-month period without penalty and at the supplier's risk and expense, with the remedies determined in accordance with the Act.

Nothing in these Terms or our Returns & Refund Policy is intended to remove or reduce those rights.

16. Custom and Personalised Products

Some PageLite products may be customised or manufactured specifically according to information, artwork, images, names, text or specifications supplied by the customer.

You are responsible for ensuring that any material you submit for customisation is correct before placing the order.

Customers must also ensure that they have the necessary rights or permission to use any image, logo, artwork, text or other material submitted to PageLite.

We may refuse customisation requests that are unlawful, infringe intellectual-property rights or contain material that we reasonably cannot reproduce.

Because customised goods are manufactured specifically for an individual customer, certain ordinary cooling-off or change-of-mind rights may not apply where permitted by law.

However, personalised products remain subject to applicable statutory protections where they are defective, damaged, incorrectly manufactured or materially fail to conform to the specifications accepted by PageLite.

17. Customer-Supplied Artwork and Images

Where you upload artwork, photographs, logos or designs for a personalised product, you retain ownership of your original material.

You grant PageLite and any service provider reasonably necessary to fulfil your order a limited permission to use, reproduce, resize, format or transmit that material solely for purposes reasonably connected with producing, fulfilling and supporting your order.

You represent that you own the material or otherwise have permission to use it for the requested purpose.

PageLite may decline to manufacture material where there are reasonable grounds to believe that doing so would infringe another person's rights or violate applicable law.

18. Intellectual Property

Unless otherwise indicated, the PageLite name, branding, website layout, original product photography, graphics, written content and other original materials belonging to PageLite are protected by applicable intellectual-property laws.

You may access and use the website for ordinary personal shopping purposes.

You may not reproduce, commercially exploit, republish, distribute or substantially copy PageLite-owned content without permission, except where permitted by law.

Third-party trademarks, product names and other intellectual property remain the property of their respective owners.

19. Reviews and Customer Content

If PageLite allows customers to submit reviews, photographs, comments or other public content, the content must be truthful and must not be unlawful, defamatory, threatening, fraudulent, misleading, obscene or infringing of another person's rights.

By voluntarily submitting content for public display on PageLite, you give us permission to display that content in connection with our store and products, subject to our Privacy Policy and applicable law.

We reserve the right to moderate or remove unlawful, fraudulent, spam or otherwise inappropriate content.

We will not knowingly manipulate customer reviews in a manner that creates a misleading impression of customer opinion.

20. Promotions and Discount Codes

Promotional offers may be subject to specific terms such as validity periods, qualifying products, minimum order values or usage limits.

Unless otherwise stated, discount codes may not be combined.

PageLite may withdraw or correct a promotion where there has been a genuine technical error, fraud or misuse, subject to applicable consumer law.

A promotion does not limit any statutory consumer rights.

21. Gift Cards

Where PageLite offers gift cards, vouchers or store credits, any terms governing them will be displayed when they are sold or issued.

Any validity period, redemption condition or other limitation will comply with applicable South African consumer law.

22. Third-Party Services

Our website may use or link to services supplied by third parties, including Shopify, payment processors, courier services, analytics providers or social-media platforms.

PageLite does not control independently operated third-party websites.

Use of those services may also be subject to the third party's own terms and privacy policies.

The presence of a link does not necessarily constitute an endorsement.

Nothing in this section excludes responsibility that PageLite has under applicable consumer law for the fulfilment of its own obligations to customers.

23. Privacy and Personal Information

PageLite processes customer information for purposes including processing orders, arranging delivery, providing customer support, preventing fraud and operating the store.

Personal information will be handled in accordance with our Privacy Policy, the Protection of Personal Information Act 4 of 2013 ("POPIA") and other applicable law.

Our Privacy Policy explains the categories of information collected, purposes for which information is used, circumstances in which information may be shared, retention practices and the rights available to data subjects.

24. Marketing Communications

PageLite may send electronic marketing communications only where permitted by applicable law.

Where consent is required, marketing will be sent in accordance with that consent.

Where marketing is sent to an existing customer under circumstances permitted by POPIA, the customer will be provided with an appropriate opportunity to object or unsubscribe.

Customers may unsubscribe from marketing communications using the unsubscribe facility provided or by contacting us.

Unsubscribing from marketing does not prevent us from sending transactional communications reasonably necessary to process an existing order.

25. Fraud and Abuse

PageLite may investigate conduct reasonably suspected to involve fraud, payment abuse, chargeback abuse, false refund claims, misuse of promotional offers or other unlawful conduct.

Where appropriate, we may cancel or refuse an affected transaction, preserve relevant records, restrict future access or refer suspected unlawful conduct to the appropriate payment provider or authorities.

Any such action will be taken subject to applicable law and will not be used to deny a legitimate consumer claim.

26. Limitation of Liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under the Consumer Protection Act or any other applicable law.

PageLite does not seek through these Terms to exclude liability for defective or unsafe goods, unlawful conduct, gross negligence or any other liability that applicable South African law does not permit us to exclude.

To the extent permitted by law, PageLite will not be responsible for losses that are wholly unrelated to our breach of these Terms or that were not reasonably foreseeable in the circumstances.

Each claim will remain subject to the rights and remedies available under applicable law.

27. Website Availability

We aim to keep our website operational and accurate but cannot guarantee uninterrupted access at all times.

We may temporarily suspend or restrict website access for maintenance, security, technical problems or operational reasons.

Where possible, such interruptions will be kept reasonably limited.

28. Changes to These Terms

We may update these Terms from time to time to reflect changes to our business, website, products or applicable law.

The version published on our website at the time of your transaction will ordinarily govern that transaction unless applicable law requires otherwise.

Material changes will not be applied retrospectively in a manner that unlawfully removes rights already acquired by a customer.

The "Last updated" date at the top of this page indicates when these Terms were most recently revised.

29. Severability

If any provision of these Terms is found to be unlawful or unenforceable, that provision will be interpreted or limited to the extent necessary to comply with applicable law.

The remaining provisions will continue to operate to the extent legally possible.

30. No Waiver of Consumer Rights

Nothing contained in these Terms, on our website or in communications from PageLite should be interpreted as requiring a consumer to waive a right that cannot lawfully be waived.

Where these Terms provide less protection than a mandatory provision of applicable consumer legislation, the legislation will prevail.

31. Governing Law

These Terms and transactions concluded through PageLite are governed by the laws of the Republic of South Africa, subject to any mandatory consumer protections that apply.

Nothing in this clause excludes any protection that ECTA or other applicable legislation expressly provides irrespective of the law chosen for an agreement.

32. Disputes

If you have a problem with an order, we encourage you to contact PageLite first so that we can attempt to resolve the matter directly.

Nothing in these Terms prevents a customer from exercising any right to approach an appropriate consumer protection body, regulatory authority, ombud, tribunal or court where permitted by law.

33. Entire Agreement

These Terms, together with the policies expressly incorporated into them, form the terms governing use of the PageLite store and purchases made through it.

Product-specific terms displayed before purchase may also form part of the transaction.

If a product-specific term conflicts with a mandatory provision of South African law, the law will prevail.
